The UK communications regulator, Ofcom, has initiated a formal investigation into Aylo, the owner of Pornhub, regarding the efficacy of its age verification protocols. The inquiry focuses on whether the company performed adequate due diligence before implementing a system that relies on Apple’s third-party verification process.

Under the Online Safety Act (OSA), platforms hosting adult content are required to implement highly effective measures to ensure users are at least 18 years old. Ofcom expressed concerns that Aylo’s current approach may not meet these standards, potentially leaving children vulnerable to inappropriate material. George Lusty, Ofcom’s Director of Enforcement, stated that the regulator expects tech firms to ensure verification methods are robust before deployment, noting that "anything less could leave children at risk."

Aylo has defended its implementation, asserting that the system utilizing Apple’s technology offers superior protection compared to other available methods. The company argued that relying on individual site-based checks could inadvertently push users toward less regulated, riskier platforms. Furthermore, Aylo noted that Ofcom had previously acknowledged Apple’s technology as a positive development for child safety.

Industry experts remain skeptical of relying solely on mobile device-based filters. Iain Corby of the Age Verification Providers Association questioned whether such systems can consistently guarantee that the individual accessing the content is the same person who originally verified their age on the device.

This investigation follows a period of significant changes for Pornhub in the UK. After reporting a 75% drop in traffic following the introduction of stricter age checks, the site briefly restricted access before reintroducing availability for certain Apple users in May. Should Ofcom find the company non-compliant with the OSA, it holds the authority to impose fines of up to £18 million or 10% of the company's annual global turnover.
